1. Scope of Application

These Terms and Conditions apply to all orders placed through our online shop by consumers and businesses.  A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is a natural or legal person, or a partnership with legal capacity, acting in the exercise of its commercial or independent professional activity when entering into a legal transaction. For businesses, the following applies: If the business uses conflicting or supplementary terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.


2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Teppichversand24 GmbH. The presentation of products in the online shop does not constitute a legally binding offer but serves as a non-binding online catalogue. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By clicking the order button, you submit a binding offer to purchase the products contained in the shopping cart. Confirmation of receipt of your order will be sent by e-mail immediately after the order has been submitted.


We accept your offer within two days by:

sending a declaration of acceptance in a separate e-mail, or

processing the payment transaction through our service provider or the selected payment service provider, where applicable.

The time at which the payment transaction is processed depends on the payment method selected (see section "Payment").

The relevant alternative is determined by whichever of the listed events occurs first.


3. Contract Language, Storage of Contract Text

The languages available for the conclusion of the contract are: German, English, French, Italian, Spanish and Dutch. We store the contract text and send you the order details and these Terms and Conditions in text form. You may view the contract text in your customer account login area.


4. Subject Matter of the Contract


4.1 Product Description

The respective product description shall be considered an essential part of the contract.


4.2 Product Images

Without prejudice to your statutory warranty rights, we would like to draw your attention to the following: If you have any doubts, please contact us. Due to individual screen configurations (e.g. resolution and brightness), minor deviations between the displayed product colours and the actual product colours may occur.


5. Delivery Conditions


5.1 Delivery Area

We deliver within Germany, Austria, the United Kingdom, France, Monaco, Italy, San Marino, Spain, Belgium, Luxembourg and the Netherlands. We do not deliver to islands.


5.2 Delivery Options

Products are shipped to the delivery address specified during the ordering process. Delivery is available by shipping only. Collection of goods is unfortunately not possible. We do not deliver to parcel stations.


5.3 Freight Forwarding Deliveries

Appointment Scheduling

For deliveries by freight carrier, the freight company commissioned by us will contact you to arrange a delivery appointment.

Place of Delivery

Delivery of the goods is limited to transportation and unloading at the first public kerbside of the agreed delivery address.

Delivery does not include transportation into specific rooms, assembly, installation, or setup of the ordered goods unless expressly agreed otherwise.


6. Payment


6.1 Prices

The prices stated at the time of ordering shall apply.

All prices are total prices and include the applicable statutory value-added tax (VAT).


6.2 Payment Methods

The following payment methods are generally available in our online shop.

Advance Payment

If you choose advance payment, we will provide our bank details in a separate e-mail and dispatch the goods after receipt of payment.


Amazon Pay

To pay via Amazon Payments Europe S.C.A., 38 Avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself using your login credentials, and confirm the payment instruction.

The payment transaction will be processed by Amazon Pay within one banking business day after the order has been placed.

Amazon Pay may offer additional payment options to registered customers selected according to its own criteria. We have no influence over the availability of such options.

Apple Pay

To pay via Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the Safari browser, be registered with Apple, have Apple Pay activated, authenticate yourself and confirm the payment instruction.

The payment transaction is processed immediately after the order is placed.

Google Pay

To pay via Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have Google Pay activated, authenticate yourself and confirm the payment instruction. The payment transaction is processed immediately after the order is placed.

PayPal

In cooperation with PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), we offer the following payment options as PayPal Services.

Unless otherwise stated below, payment via PayPal does not require registration with PayPal.

PayPal / PayPal Express

To pay via PayPal, you must be registered with PayPal, authenticate yourself and confirm the payment instruction. The payment transaction is processed immediately after the order has been placed.

Credit Card via PayPal

Your credit card will be charged by PayPal after the goods have been dispatched.

Direct Debit via PayPal

Payment by direct debit via PayPal requires an address and credit check and is processed directly by PayPal. By confirming the payment instruction, you grant PayPal a direct debit mandate. PayPal will inform you of the date on which your account will be debited. The account will be charged before dispatch of the goods.

Purchase on Account via PayPal and Ratepay

Purchase on account via PayPal requires an address and credit check and is processed directly by Ratepay GmbH, Franklinstraße 28-29, 10587 Berlin, Germany ("Ratepay").


7. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal as described in the withdrawal policy. Businesses are not granted a voluntary right of withdrawal.


8. Retention of Title

The goods remain our property until full payment has been received. For businesses, the following additionally applies: We retain ownership of the goods until all claims arising from an ongoing business relationship have been settled in full. The business may resell the goods subject to retention of title in the ordinary course of business. All claims arising from such resale are assigned to us in advance up to the invoice amount, irrespective of whether the goods are combined or mixed with other items. We hereby accept such assignment. The business remains authorised to collect the claims, but we may also collect them ourselves if the business fails to fulfil its payment obligations. We shall release securities upon request insofar as their realisable value exceeds the value of the outstanding claims by more than 10%.


9. Transport Damage

For consumers:

If goods are delivered with obvious transport damage, please report such defects to the delivery company as soon as possible and contact us without delay. Failure to make a complaint or contact us shall have no consequences for your statutory rights and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance provider.

For businesses:

The risk of accidental loss or accidental deterioration of the goods passes to you as soon as we have handed over the goods to the freight forwarder, carrier, or any other person or institution designated to carry out the shipment.


10. Warranty and Guarantees


10.1 Statutory Warranty Rights

Unless expressly agreed otherwise below, the statutory provisions governing liability for defects shall apply. The following limitations and reductions of limitation periods shall not apply to claims arising from damages caused by us, our legal representatives, or our agents:

in the event of injury to life, body, or health;

in the event of intentional or grossly negligent breach of duty;

in cases of fraudulent concealment;

in the event of breach of essential contractual obligations (cardinal obligations), the fulfilment of which is necessary for the proper performance of the contract and on whose compliance the contractual partner may regularly rely;

within the scope of a guarantee, where agreed; or

where liability under mandatory product liability legislation applies.


Restrictions for Businesses

With regard to businesses, only our own specifications and the manufacturer's product descriptions incorporated into the contract shall be deemed agreed characteristics of the goods. We assume no liability for public statements made by the manufacturer or other advertising claims. For businesses, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk. The previous sentence shall not apply to goods that have been used for a building in accordance with their usual purpose and have caused the defectiveness of the building. Statutory limitation periods for recourse claims pursuant to Section 445a of the German Civil Code (BGB) remain unaffected.


Notice to Merchants

For merchants, the inspection and notification obligations pursuant to Section 377 of the German Commercial Code (HGB) shall apply. If you fail to provide the notification stipulated therein, the goods shall be deemed approved unless the defect was not identifiable during inspection. This shall not apply if we have fraudulently concealed a defect.


10.2 Guarantees and Customer Service

11. Liability

We shall always be liable without limitation for claims arising from damages caused by us, our legal representatives, or our agents:

in the event of injury to life, body, or health;

in the event of intentional or grossly negligent breach of duty;

in the event of guarantees, where agreed; or

where liability under mandatory product liability legislation applies.


In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), whose fulfilment is necessary for the proper performance of the contract and on whose compliance the contractual partner may regularly rely, our liability shall be limited to the foreseeable damage typical for the contract at the time of its conclusion. Otherwise, claims for damages are excluded.


12. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


13. Final Provisions

If you are a business, German law shall apply to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).


If you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you shall be our registered place of business.

Should individual provisions of these Terms and Conditions be wholly or partially invalid, the remainder of the contract shall remain unaffected.

To the extent that individual provisions are invalid, the content of the contract shall be governed by the applicable statutory provisions.
